REPUBLIC ACT NO. 10368
AN ACT PROVIDING FOR REPARATION AND RECOGNITION OF VICTIMS OF HUMAN RIGHTS VIOLATIONS DURING THE MARCOS REGIME, DOCUMENTATION OF SAID VIOLATIONS, APPROPRIATING FUNDS THEREFOR AND FOR OTHER PURPOSES
Ang iniuutos ng batas:
“Consistent with the foregoing, it is hereby declared the policy of the State to recognize the heroism and sacrifices of all Filipinos who were victims of summary execution, torture, enforced or involuntary disappearance and other gross human rights violations committed during the regime of former President Ferdinand E. Marcos covering the period from September 21, 1972 to February 25, 1986 and restore the victims’ honor and dignity. The State hereby acknowledges its moral and legal obligation to recognize and/or provide reparation to said victims and/or their families for the deaths, injuries, sufferings, deprivations and damages they suffered under the Marcos regime.
Similarly, it is the obligation of the State to acknowledge the sufferings and damages inflicted upon persons whose properties or businesses were forcibly taken over, sequestered or used, or those whose professions were damaged and/or impaired, or those whose freedom of movement was restricted, and/or such other victims of the violations of the Bill of Rights.”
Masasabi natin na ang batas na RA 10368, na ipinasa ng Senado nang si Enrile ang Senate President, kasama ng mga mambabatas sa Senado at Kamara ay may layong magpatupad ng mga polisiyang ito ayon sa section 2:
(1) Kilalanin at i-dokumento ang malawakang “summary execution, torture, enforced or involuntary disappearances and other gross human rights violations committed during the regime of former President Ferdinand E. Marcos covering the period from September 21, 1972 to February 25, 1986 (section 2);
(2) “(R)ecognize the heroism and sacrifice of all Filipinos who were victims of (such acts)” na na-describe sa number 1;
(3) “(R)estore the victims’ honor and dignity”;
(4) Kilalanin na ang estado ay may “moral and legal obligation to recognize and/or provide reparation to said victims and/or their families for the deaths, injuries, sufferings, deprivations and damages they suffered under the Marcos regime’;
(5) Kilalanin ang obligasyon ng estado “to acknowledge the sufferings and damages inflicted upon persons whose properties or businesses were forcibly taken over, sequestered or used, or those whose professions were damaged and/or impaired, of those whose freedom of movement were restricted, and/or such other victims of the violations of the Bill of Rights.”
Gumawa ng Human Rights Victims’ Claims Board (HRVCB) ang batas na nilagdaan ni Enrile. Pinangunahan ito ng dating retired Philippine National Police Director (equivalent sa Major General) na si Lina Sarmiento. So hindi masasabing biased si Gen. Sarmiento para sa mga aktibista. Nag-announce ang HRVCB, bago nila tinapos ang two-year term nila, na nag-approve sila ng 11,103 claimants. Yun lang po ang natapos nilang i-process, pero ang total applicants ay 75,749.
Napakaganda pong history lesson ito para sa lahat ng Pilipino, lalo na ang mga kabataang hindi nakaranas ng Martial Law. Pati si Enrile, kinilala ang kasaysayang ito. At pinondohan pa iyan ni Enrile, atbp. Magkano po ang pinangpondo diyan? Yung PhP 10 billion na galing sa ninakaw ni Ferdinand at Imelda Marcos na Swiss accounts. Huwag po nating kalimutan, napakaraming ebidensya pati sa mga korte sa Estados Unidos at Pilipinas, ng malawakang pambibiktima ng Martial Law. Pati si Enrile, yun ang paniwala. Tapos, babaligtad siya ngayon at sasabihing iisa lang ang namatay nung Martial Law. Ano yun?
